Diddy Asks Federal Judge To Toss Clayton Howard Lawsuit Ahead Of Oct 21 Hearing

Written by on 16 October 2026

The Diddy legal saga is still unfolding, and the next big date is already on the calendar. Sean “Diddy” Combs is asking a federal judge to dismiss Clayton Howard’s amended lawsuit, with a hearing scheduled for October 21. The filings — first obtained by TMZ — lay out Combs’ full defense against the former male escort, now a law student, who has accused Combs of coercion during paid encounters.

In an October 7 filing, Combs and two of his companies argue Howard could choose which services he offered and reject requests, so paid encounters don’t support coercion claims. The language is blunt: the filing calls Howard an “enabler and exploiter,” labels him a “prostitute” paid for adult services as a living, and compares his services to a restaurant offering choices “on and off the menu.” It alleges Howard returned repeatedly for paid encounters and only sued after payments stopped. All of these are Combs’ assertions in his defense — not findings by the court.

Howard’s complaint tells a very different story. He counters that agreeing to paid encounters didn’t mean consenting to everything — alleging drugs, misrepresentation, and physical restraint, including a 2016 Miami trip where his clothes, ID, and phone were taken, and where he says he witnessed Combs assault Cassie Ventura before being confined in a room for roughly 12 hours.

Background: Howard sued Combs and Cassie in June 2025. In the criminal case, a jury acquitted Combs of racketeering conspiracy and sex trafficking but convicted him on two counts of transportation for prostitution — he is serving a 50-month sentence at FCI Fort Dix in New Jersey, with release most recently listed as March 2, 2028. In July 2026, a judge let several of Howard’s civil claims proceed while dismissing claims against Cassie Ventura with leave to amend — both sides now want those amended claims gone.

The October 21 hearing will center on consent: Combs’ team says Howard could have refused; Howard says paid sex didn’t mean giving up control over what happened. Until the judge rules, both positions remain contested. We’ll be watching.
