Takeoff’s Estate Wants Sexual Assault Lawsuit Tossed, Claiming Accuser Deleted Key Texts

The estate of Takeoff is asking a judge to throw out the civil sexual assault lawsuit filed against the late Migos rapper, arguing the accuser destroyed evidence that could have helped the defense.
According to a report from MyNewsLA, lawyers for Takeoff’s mother, Titania Patrice Davenport, and his estate filed legal documents on Tuesday, October 27, asking Judge Huey P. Cotton to impose “terminating sanctions” on the plaintiff — a move that, if granted, would dismiss the case and could result in a default judgment against the accuser.
The dispute dates back to 2020, when a woman identified only as Jane Doe accused Takeoff of sexually assaulting her at a party in Encino, California. Prosecutors ultimately declined to pursue criminal charges — the Los Angeles County District Attorney’s Office rejected prosecution in April 2021 due to insufficient evidence — but Doe filed a civil lawsuit later that year. Takeoff denied the allegations before his death. He was shot and killed at a bowling alley in Houston on November 1, 2022, and the civil case has continued against his estate.
The estate’s new filing centers on what happened to the accuser’s text messages. The documents cite Doe’s October 14 deposition, during which she reportedly admitted to deleting everything in her phone after she filed the lawsuit. “Plaintiff Jane Doe has admitted under oath that she systematically double-deleted her text messages relevant to this lawsuit after she had already filed her complaint,” the filing reportedly reads, calling the deletions spoliation of evidence.
The estate argues the missing messages matter because Doe plans to rely on select messages in her case — what the defense calls “cherry-picked snippets, the same token, self-selected snippets she shared with the police” — while entire text threads with the same third parties and other witnesses were deleted. The filing also points to testimony from one of Doe’s friends, who the estate says testified that the allegations were fabricated with the help of other friends Doe had texted with.
“The court should not tolerate such conduct and should impose terminating sanctions in the form of dismissing plaintiff’s case,” the documents reportedly argue.
XXL reports a hearing on the motion is scheduled for January 26, 2027, and that the outlet has reached out to Takeoff’s attorney for comment. HotNewHipHop also notes the accuser has filed a $6 million creditor’s claim against the estate.
For fans, the case is a painful reminder of how much unfinished business followed Takeoff’s tragic death just days before the fourth anniversary of his passing. His legacy with Migos — one of the most influential groups of the trap era — remains untouchable, but the legal battles over his estate continue to play out in court.
